SoundBirth Privacy Policy

This Privacy Policy explains how we collect, use, share, and protect personal data when you use the SoundBirth Service(our app, website, and related tools). It also describes your privacy rights under applicable law, including the EU/EEA GDPR.

If you do not agree with this Policy, please do not use the Service.

1. Who we are & scope

  • Controller. For the SoundBirth Service, SOUNDBIRTH SAS acts as data controller.
  • Separate controllers. Certain features give you access to Partner Services (e.g., SACEM – MusicStart). For those Partner Services, the Partner is usually an independent controller of your data (see §8 below).
  • This Policy covers: our mobile apps, websites, and online services that link to this Policy.

2. Categories of data we collect

We collect and process the following categories (as applicable):

  • Account & profile: name, display name, email, password hash, country, language, username/urls, roles (artist, label, curator, creator).
  • Artist & content metadata: stage name, label name, release metadata (title, album, contributors), ISRC/UPC, artwork info, lyrics, split information & percentages, collaborator emails.
  • Usage & device: app actions, session data, crash logs, performance metrics, device identifiers, IP address, OS & model, app version, referral source.
  • Marketplace & Mentors: submissions, feedback, links to posts (e.g., TikTok/Reels/Shorts), call bookings, attendance confirmations, dispute details.
  • Payments/royalties: subscription plan, transaction IDs, billing country/currency, payout method (e.g., bank/PayPal), royalty statements, balances, invoices/receipts, VAT numbers where applicable.
  • KYC/AML (where required): identity document details, proof of address, beneficial owner information (for payouts/advances/fraud prevention).
  • Support: messages, attachments you send us (e.g., screenshots, IDs when requested), ticket metadata.
  • Marketing preferences: newsletter opt-in/opt-out, campaign interactions.
  • Cookies/online identifiers: cookie IDs, pixels, local storage, SDK identifiers (see §10).

We do not require sensitive data unless mandated for compliance (e.g., KYC for payouts/advances). Please do not upload unnecessary sensitive information.

3. Purposes & legal bases

We process your data for:

  1. Providing the Service & core features (account, distribution workflows, splits, dashboards) — Art. 6(1)(b) GDPR (contract).
  2. Royalties & payouts (statements, thresholds, payment execution) — contract; related legal obligations(tax/accounting).
  3. Subscription billing (in-app/web), fraud prevention, chargebacks, enforcement — contract; legitimate interestsArt. 6(1)(f).
  4. Partner Services enablement (e.g., MusicStart) — contract to provide the Partner Service you request; legitimate interests for integration security & maintenance.
  5. Marketplace & Mentors features (submissions, feedback, calls, dispute handling) — contract; legitimate interests for trust & safety.
  6. Product analytics & service improvement (aggregated metrics, crash logs) — legitimate interests.
  7. Security & abuse prevention (anti-fraud, bot/stream manipulation investigations, account integrity) — legitimate interests; may rely on legal obligation if applicable.
  8. Marketing communications (newsletters, features) — consent where required; otherwise legitimate interests.
  9. Legal compliance (accounting, tax, responses to lawful requests) — legal obligation.
  10. Prospective advances (eligibility modeling, recoupment management) — contract; legitimate interests for risk management.

Where we rely on consent, you can withdraw it at any time (this does not affect prior processing).

4. Partner Services & data sharing (e.g., SACEM – MusicStart)

When you opt to access a Partner Service from within SoundBirth, we share the minimum data necessary to enable that service, such as:

  • Account identifiers and contact details;
  • Your works’ metadata (e.g., titles, ISRC/UPC, authorship info);
  • Timestamps/proofs and documents required by the Partner (e.g., for MusicStart);
  • Where applicable, billing identifiers related to the Partner Service.

The Partner processes this data under its own terms and privacy policy. For general rules applicable to Partner Services, see Terms of Use §8 and Payment & Subscriptions Terms §3.

SoundBirth is not a party to your agreement with the Partner (unless expressly stated). We may suspend or remove an integration at any time (e.g., partner discontinuation, compliance reasons).

Important clarifications (MusicStart example). MusicStart is a proof/timestamp tool. It does not transfer rights or guarantee acceptance by any rights organization. Membership/registration decisions (e.g., with SACEM) are made solely by those organizations.

Legal bases: contract (to provide the Partner Service you requested) and legitimate interests (integration security, fraud prevention, maintenance). Where law requires consent, we will obtain it.

5. Marketplace & Mentors

For Marketplace submissions, creator posts, and one-to-one mentor calls, we process: order details, feedback, proof-of-delivery links, scheduling/attendance, and disputes. We may share limited information with the relevant Creator/Curator/Mentor to fulfill the order and verify delivery. See also the Payment & Subscriptions Terms §7(Marketplace) and §6 (Advances) for financial consequences in case of fraud/abuse.

6. Payments, payouts & KYC

For subscriptions and web checkouts, payments are processed by Apple App Store, Google Play, or our payment processor (merchant of record may vary where permitted). For payouts and royalty advances, we may request KYC/AML verification and use specialized vendors to validate identity and prevent fraud. We may delay payouts during verification or investigations (see Payment & Subscriptions Terms).

7. Recipients (who we share with)

We share data with:

  • Partners providing optional services (e.g., SACEM – MusicStart) — see §4;
  • Payment & payout providers (card processors, bank/PayPal, chargeback handlers);
  • KYC/AML vendors (identity checks), fraud prevention and trust & safety vendors;
  • Hosting & infrastructure, CDN, analytics, logging, email and support providers;
  • Professional advisors (legal, accounting) and authorities where required by law;
  • Corporate transactions: in the context of mergers, acquisitions, financing, or asset transfers, under appropriate safeguards.

We sign data processing agreements with processors and require appropriate security measures.

8. Retention

We retain data only as long as necessary for the purposes described:

  • Account data: life of the account + up to 24 months after closure (for support and defense of claims), unless a longer period is required.
  • Royalty statements & accounting: typically 6–10 years (statutory requirements vary).
  • Partner Services data: for the duration of your use + up to 36 months, then deletion or anonymization (unless law requires longer).
  • KYC/AML: per legal/regulatory requirements (often 5–10 years).
  • Logs & security: typically 12–24 months.
  • Marketing: until opt-out or up to 24 months after last interaction, whichever is earlier.

9. Cookies, SDKs & similar technologies

We use cookies/SDKs for authentication, preferences, performance, analytics, and (where permitted) marketing. Where required, we display a consent banner and honor your choices.

  • Manage web preferences via our banner and browser controls.
  • Manage in-app tracking in your device settings (e.g., App Tracking Transparency on iOS).

10. Security

We implement technical and organizational measures appropriate to the risk (encryption in transit, access controls, audit logs, least-privilege, vendor due diligence). No system is 100% secure; please protect your credentials and notify us immediately of any suspected unauthorized access.

11. Your rights

Subject to local law, you may have the right to access, rectify, erase, restrict or object to processing, and data portability. Where we rely on consent, you can withdraw it at any time. You also have the right to lodge a complaint with a supervisory authority.

We do not use solely automated decisions that produce legal or similarly significant effects without your explicit consent or where otherwise permitted by law with suitable safeguards.

12. Children

The Service is not directed to children under 16 (or the age defined by local law). We do not knowingly collect personal data from children under that age. If you believe a child has provided data, contact us to request deletion.

13. Changes to this Policy

We may update this Policy from time to time. For material changes, we will provide prominent notice (e.g., in-app notice or email) and indicate the effective date. Continued use after the effective date constitutes acceptance.
